Defense Verdict for Dentist and Expanded Function Dental Assistant in Philadelphia County

Sarah Baker obtained a unanimous defense verdict for her clients, a dentist and his expanded function dental assistant (EFDA) in a 4-day jury trial in Philadelphia County.  The EFDA was accused of having suctioned the plaintiff’s uvula during a filling replacement, causing the uvula to become distended and bothersome.  Ultimately, the uvula was removed.

The defense contended, and proved, that the Plaintiff’s complaints regarding the condition of her uvula were in fact related to disease within the tissue, and not to the dental treatment.  Further, the defense proved, through the testimony of its expert witnesses, that the patient’s complaints regarding the uvula’s condition following the dental treatment were inconsistent with trauma.
