|Kiernan Trebach Attorney Nimi Amirthalingam Obtains Summary Judgment on Behalf of Metropolitan Transit System|
Nimi Amirthalingam of Kiernan Trebach's D.C. office obtained summary judgment on behalf of a local metropolitan transit system. Plaintiff alleged that the decedent fell over a wall that abuts the station platform. As a result of the fall, the decedent died and Plaintiff alleged that the transit system was negligent in failing to discover the decedent before he succumbed to his injuries.
Mr. Amirthalingam was brought into this USDC case after discovery had closed. He filed a motion for summary judgment based upon the plaintiff's contributory negligence. The Court granted the motion and agreed that the decedent's act of sitting on the parapet wall in a state of intoxication, and then falling off of the wall, was the proximate cause of his death and he was contributorily negligent as a matter of law.
