Since the explosion of environmental regulations in the early 1970s, the Firm has represented local and regional clients before state and federal courts. In addition, we work with corporate clients to implement nationwide environmental audit, compliance and training programs.
The Firm has also developed a special expertise defending industry clients from lawsuits filed by employees and others who claim exposure to toxic substances. Our attorneys have represented manufacturers and users of commercial products in cases alleging injury by reason of chronic exposure to such substances. Over a decades-long involvement in litigation alleging toxic encephalopathy and other neurological injuries, we have developed an expertise in dealing with the unique evidentiary problems relating to the admissibility and significance of SPECT-scan and PET-scan results, and in handling such problems in the post-Daubert era.
Building Related Illness [BRI]
The Firm’s attorneys are also at the forefront of significant, building-related cases involving exposure to mold, toxic fumes and silica allegedly arising from defects in the design of major commercial structures, or from deficient techniques in construction and remediation. Our decades-long involvement and expertise in the defense of lead paint cases has made Kiernan Treabch a ready and valued source of expertise in cases involving failure to control the development and dispersion of mold in cases involving aspergillis, stachybotrys and other naturally-occurring irritants.
