Alternative Dispute Resolution
Kiernan Trebach is focused on cost-effective resolution of disputes. Our attorneys have extensive experience in alternative dispute resolution, both as participant litigators and as neutrals.
Members of the firm provide their services to local and federal courts, and also serve as instructors for and evaluators of other mediators and judges. The scope of our ADR experience is comparable to the scope of practice areas across the firm, including resolution of tort cases, commercial disputes, real estate, medical and professional malpractice, employment, and many other practice areas. We have served as mediators, arbitrators and neutral case evaluators in disputes prior to the filing of a lawsuit, at the trial court level and for cases pending at the appellate level. Members of our firm have been privately retained to provide ADR services and have also provided pro bono services to the local and federal courts.
Mock Jury Panels
The lawyers of Kiernan Trebach are experienced in the organization and presentation of mock jury panels with a statistically representative sample from the actual jury pool where the case will be tried. This service allows our clients to more fully evaluate the risks associated with trying a particular case, the likely range of adverse verdicts, and the effectiveness of proposed trial arguments. We create our own juror questionnaire, use our own video capabilities and provide a variety of experts to participate in the mock trial process. In some instances, we also engage vendors to provide those services, depending on client preferences and cost factors. Our ability to provide these services allows our clients to obtain the best possible insight for successfully and efficiently defending their cases.

While not every case should be tried, every case should be prepared by attorneys focused on the best strategic approach to trial. Our philosophy is founded on the proposition that a “litigator” must be capable and prepared to try each case, if necessary. We credit the dozens of cases tried by our lawyers over each year as playing a critical role in the hundreds of successful pretrial dispositions that occur during the same period.
Kiernan Trebach devotes significant resources to training its associates as trial lawyers. Under the tutelage of the firm’s senior trial counsel, associate attorneys are provided the opportunity to develop the skills and knowledge that are the tools of an accomplished trial lawyer.
Appellate Practice
Obtaining a favorable jury verdict is often only half the battle. Kiernan Trebach also offers experienced appellate counsel. Backed by a dedicated research staff, our appellate attorneys ensure that the effort to protect a favorable verdict is just as effective as our trial court services. Our attorneys have briefed and argued precedent-setting appeals in courts throughout the nation.
